Zimini Merchant Use & Refund Policy (Rev. 06-04-07)
At Zimini, we recognize that growing your business is important to your livelihood,
your employees, suppliers, contractors and community. We developed Zimini with the
intent to provide another tool that merchants and marketers can use to grow their
businesses. This document describes our performance guarantee and our refund policy
that apply when you use Zimini's services. We hope that our efforts will help you
to understand the uses and limitations of Zimini, and to help you to make a confident
decision about using our products and services.
No Performance Gaurantee
Zimini is a marketing tool used to promote your products and services to a broad
set of potential and current customers; and like all marketing and sales tools,
there is a wide variety of attributes that can impact the results delivered by Zimini.
As such, we make no guarantee that Zimini will help you acquire or retain customers,
build awareness about your product or service, or sell your product or service.
If fact, there are many other attributes; including but not limited to: the reputation
of your business, the specific offer you are providing, competing offers, your specific
product or service, and price of competitors products or services that can positively
or negatively impact the results of your coupon, promotion or special offer on Zimini.
The use of Zimini’s Services by a merchant is also subject to Zimini’s End User
License Agreement for Zimini Consumer and Merchant Software, and Zimini’s Subscriber
Agreement and Terms of Use.
Targeting Data
Zimini provides you with several different types of data to help you find the best
customers for your product and service, these include both geographic and demographic
data.
Because Zimini users enter this data themselves, and keep it up-to-date on their
personal computer, we believe it is more accurate than data obtained by other methods.
In addition, consumers can change, update or delete this data anytime their interests
or situation changes, providing a greater likelihood that the data is accurate compared
to other means of data collection. We believe that providing consumers with the
ability to delete, change, add or update their personal profile through of Zimini
software application provides benefits for both merchants and consumers. However,
there is no way that we can guarantee the data is 100% accurate.
Zimini also provides merchants with the ability to use geographic targeting. This
can be especially valuable for local merchants. We use the latest, and most advanced
geographic target tools, and continually refine these tools to improve them.
Before you complete and launch a Zimini coupon, promotion or special offer; we attempt
to provide you with an estimate of the number of Zimini consumer users who will
receive your promotion. This estimate is provided on the Promotion Summary screen
prior payment for your promotion. This estimate is only an estimate, and is in no
way a guarantee that any specific number of Zimini consumer users will receive,
view or use your promotion, coupon or special offer. Zimini estimates are based
on our current and best knowledge and are subject to change as new users may join
Zimini and current users may elect to remove their profile from Zimini.
Refund Policy
Once you have created and paid for a Zimini promotion, you have used Zimini's software
and services. You have used our software, geographic targeting algorithms, demographic
profiles, and coupon creation tools to develop your promotion, coupon or special
offer. As such, once you have created and paid for your Zimini promotion, coupon
or special offer; we cannot provide a refund.
